Terms of Service

These terms govern your use of the hosted Nitlist service at nitlist.dev. By creating an account or using the service, you agree to them.
01 The service
Nitlist lets you add a one-line script to sites you deploy so your clients can click an element and leave a note that arrives, pinned to that spot, on your dashboard. These terms cover the hosted service we operate.
02 Open source vs. the hosted service
The Nitlist app and backend are open source. You are free to self-host them under their open-source license [confirm license, e.g. MIT]. When you self-host, your use is governed by that license — not by these terms. These terms apply only when you use the hosted service we run.
03 Your account
You must provide accurate information and keep your credentials and API keys secure. You are responsible for all activity under your account and your keys. Tell us promptly if you suspect unauthorized access.
04 Acceptable use
You agree not to:
- Install the widget on sites you don't own or aren't authorized to instrument.
- Use Nitlist to collect data unlawfully or without the consent your jurisdiction requires.
- Attack, overload, reverse-engineer around the rate limits, or otherwise abuse the service.
- Use the service to harvest or profile third parties.
05 Your data and content
You own your projects and the feedback collected through them. You grant us a limited license to host and process that data solely to provide the service. You are responsible for having the right to collect feedback on the sites you instrument and for what your reviewers submit.
06 Plans, seats, and billing
The hosted plan is billed at $5 per seat per month. A seat is one developer with access to the dashboard; your clients and reviewers are free guests and never count as seats. Subscriptions renew automatically until cancelled.
You can add or remove seats and cancel at any time. Fees already paid are non-refundable except where the law requires otherwise. We may change pricing with reasonable advance notice.
07 Free guests
Reviewers use the widget without an account. You are responsible for ensuring their use, through your projects, complies with these terms and applicable law.
08 Intellectual property
The Nitlist name, brand, and the hosted service are owned by us and our licensors. The open-source code is licensed separately under its open-source license. Nothing in these terms transfers ownership of our brand to you.
09 Third-party services
The hosted service relies on third parties (including our backend host, email provider, and payment processor). Their availability and terms may affect the service, and we are not responsible for their acts or omissions.
10 Disclaimers
The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We don't warrant that the service will be uninterrupted or error-free.
11 Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the greater of the fees you paid us in the twelve months before the claim or USD 100.
12 Indemnification
You agree to indemnify and hold us harmless from claims arising out of your use of the service, the sites you instrument, the data you collect, or your reviewers' content.
13 Termination
You may stop using the service at any time. We may suspend or terminate access for breach of these terms or to protect the service. If we terminate the hosted service, the open-source version remains available to you under its license.
14 Changes to these terms
We may update these terms. We'll change the “last updated” date above and, for material changes, give notice through the service. Continued use after changes means you accept them.
15 Governing law
These terms are governed by the laws of [your jurisdiction], without regard to conflict-of-laws rules. [Set your jurisdiction and dispute-resolution venue before launch.]
